Ratings and Reviews
In order to be able to leave a rating & review for a law firm you must be a Registered User (the 'User') of the JustBeagle website (the 'Website').
1. CRITERIA
Before leaving a rating & review, the User agrees to comply with the following:
a) The User warrants they were a fee-paying client of the law firm for whom the review is being written.
b) The matter about which the User is reviewing concluded within the last six months.
c) The User may not provide a rating & review for a law firm to which the User has a personal or professional relationship.
2. REVIEW MANAGEMENT
In leaving a rating & review you accept the following management of your feedback:
a) Any rating left will be notified to the law firm concerned. By using this service as a reviewer, you consent to us providing the law firm with your contact details, including your name and e-mail address.
b) Any rating left for which the star rating is 3 and above will be automatically published, together with any review.
c) Any rating left for which the star rating is a 1 or 2 will be held ‘pending’. The User will be notified accordingly and the following process will be undertaken:
The administrators of the Website will check whether the law firm has Review Management Services in place if not the rating will be automatically published and the User notified.
If the law firm has Review Management Services, they will notified of the 1 or 2 star rating and will be asked to verify that the User complies with the Criteria detailed above. The law firm has five days to comply.
If the Website administrators do not have a response from the law firm after five business days (Mon – Fri 09.00 to 17.00 not including bank holidays), then the star rating and any written review will be automatically published.
If the law firm confirms the User does not meet the Criteria, the User will be notified and the rating and any written review will not be published.
If the law firm confirms the User meets the Criteria, then the law firm has the option to either accept the rating and any written review, which will be published, or the Website administrator will manage a process with the User which may be via Resolver, in an effort to deal with the issue. The anticipated outcome will be the ability to publish the star rating given, together with any supporting written review or change to a revised star rating plus any changes to the written review, by agreement with the User and the law firm.
If a poor review or rating is challenged by a law firm, the User must be prepared to provide any documentary evidence in support of their review or rating to the law firm.
4. GENERAL TERMS
Registered Users must not publish content on the website which:
a) is of a marketing nature or marketing purposes;
b) is unlawful, deceptive, misleading, fraudulent, threatening, abusive, harassing, libelous, defamatory, tortious, obscene, pornographic or profane;
c) has sexist, political or racial character;
d) violates other people's rights, including any intellectual property rights;
e) is offensive or in any way breaches any applicable local, national or international law or regulation;
f) violates this Ratings & Review Policy or our Acceptable Use Policy;
g) has a disloyal or unlawful purpose and/or content (or promotes unlawful purposes);
h) is technically harmful (including without limitation computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software, harmful data or conduct).
The User warrants in every context that the rating & review is lawful and in compliance with the Terms of Use & Acceptable Use Policies. If we receive notice or otherwise become aware that the rating & review violates current legislation and/or the terms of use, we may delete the rating & review without any notice, and we - dependent on the character of the violation - may inform the violated party and/or the authorities of the violation. Our right to delete a review or rating will not be conditional upon an explanation, although we will strive to inform the User about the deletion and the reason thereof.
The User warrants that the rating & review on the Website is correct and true (where the statement/s are factual) or genuinely held (where it is a statement of opinion).
5. LIABILITY AND INDEMNITY
The User is liable for their rating & review that is published on the Website.
The User must guarantee to indemnify us for any claims which may be made against us, due to the Registered User's violation of the Terms of Use, Acceptable Use Policy or current legislation. The User must indemnify and hold us harmless from and against any claim or loss due to third party claims against us resulting from the review & rating of the User.
To the fullest extent permitted by law, the rights (including all intellectual property rights) in any reviews, created on the Website by the Users are licensed to JustBeagle for its non-exclusive use. The User is not entitled to royalty payments or any other compensation or fee. We may freely use and transfer the content. Our non-exclusive access to freely use the content applies irrevocably without any time limitation and without territorial limitations
6. JURISDICTION
The English Courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.
This Policy and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
7. AMENDMENTS TO THIS POLICY
We may revise this Policy at any time by amending this page. We will also update the ‘Last Modified’ date at the bottom of this Ratings & Review Policy. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you. Some of the provisions contained in this Policy may also be superseded by provisions or notices published.
