As your trusted Solicitor in Oldham and Todmorden, Wrigley Claydon has solid foundations that allows us to move with the times to help you through the legal process stress free. We've had a continuous presence as a Solicitor in Oldham since the practice was established in 1795 by Henry Barlow. It was 60 years later when our now namesake Henry Wrigley joined the firm. Today his great great great granddaughter is still a client.

 

We celebrated our 200 year anniversary in 1995 having expanded our offices into the Todmorden area in 1980. This gives us flexibility to serve all our clients legal needs at both offices, at their home or place of business. The Oldham office is headed up by Senior Partner Vijay Srivastava and our Todmorden team by Partner Emma Piszkalo.

Our team enjoys what we do and some of us sit on industry panels and boards. Several of us also contribute to the local area whether it's playing for the local football team or sitting on the school board.

£ 114.00 | Wills - Single will | Level 2

Preparation of a straightforward basic will for an individual. A Basic Will includes appointment of executors, appointment of guardians for minor children, if necessary and a gift of your estate to one person or divided between more than one person.

What's included:

Appointment to discuss your requirements

Consideration of whether Inheritance tax will be payable on your estate

Preparation of the draft Will for approval

Once approved arranging for the Will to be signed and witnessed

What's not included:

Any tax planning issues or solutions other than inheritance tax levels and the likely tax due on the basis of your current assets

No trusts or property rights of residence will be included

Home Visits - charged at £60 plus mileage at 40p per mile

 

* To include a right to reside, more than two legacies and the residuary estate into more shares the fee will be £180.00.

* To include a discretionary trust in your Will the fee will be £240.00.

A Grant Only Service designed for executors and administrators who have the time to deal with administering the assets themselves, but wish to have the necessary documents relating to Inheritance tax and obtaining the Grant of Representation prepared on their behalf. The administrator or executor will be required to provide all asset information. The estate must be valued below the Inheritance tax Threshold to be able to use this service, ie there will be no inheritance tax to pay.

What is included:

Initial interview to advise you on available options

Receiving and reviewing the Death certificate

Receiving and checking the Will (if there is one) and advising you on it

Receiving and reviewing all paperwork relating to the assets and liabilities, you will provide all the values.

Preparing form IHT205 and if necessary IHT217 for transferable Nil Rate Band

Preparing Oath for Executor or Oath for Administrator

Apply to the Probate Registry for the Grant of Probate or Letters of Administration

Dealing with any queries from the Probate Registry Advice on searching for lost assets

Advice on statutory advertising to protect the Executors

Receiving the Grant of Probate or Letters of Administration

Sending you the Grant of Probate or Letters of Administration

What's not included:

Corresponding with financial institutions and obtaining any financial information

Obtaining any valuations of assets (and any associated fees)

Any disbursements payable, for example, court fees and swear fees 

Completion of forms where an amount of Inheritance Tax is due (IHT 400 and supporting documents)

Any other issues arising relating to validity of the Will or if Probate is contested

Any distribution of the estate. This will be the administrator or executors responsibility

Home Visits - charged at £60 plus mileage at 40p per mile

If later on you decide you wish the firm to deal with the full administration they would be happy to do so.

During small claims it may be necessary to prepare a witness statement. Assistance with this can be obtained for a fixed fee.

What's included:

Meeting you to discuss the statement that is required

Advising you on the infomation that should and can be included in the statement

Preparation of the draft statement for your approval

What's not included:

Correspondence with the other party or the Court

Completion of any documents or forms

Court fees

Attendance at hearings

 

* For each additional statement there will be a further fee of £60 per statement

Preparation of two Lasting Powers of Attorney either one of each type (Health and Welfare & Property and Financial Matters) or for couples two of the same type of Lasting Power of Attorney.  

What's included:

Meeting with you to discuss your requirements

A Codicil is a document that can make an amendment to your Will but does not make your Will invalid. It will be read with your Will.

What's included:

Meeting to discuss what you wish to achieve with the Codicil

Preparation of the Codicil

Ensuring that the Codicil is signed and witnessed correctly to be legally enforceable.

What's not included:

Advice on other issues relating to your Will such as tax planning.

If mirror codicils are required for a couple then the fee will be £120.00

 

 

£ 120.00 | Co-habitation Agreement - Notice of Severance | Level 1

A severance of your tenancy when you own a property with another person means that instead of holding the property as a 'Joint Tenant' so when you die the property automatically passes to the survivor, you will own the property as 'Tenants in Common'. This means that you can then leave your share of the property to whoever you wish in your Will.

Advising on the effect of the severance

Preparing the necessary documents

Registering the Notice with HM Land Registry (HMLR)

Confirming the Notice of Severance has been placed on your title held at HMLR

What's not included:

Negotiations or correspondence with another party

Assistance completing the necessary form to apply

If you wish for a Lawyer to be your representative at a hearing in the Small Claims Court.  Your lawyer will have to be paid by you whether you win your claim or not.

Consideration of large volumes of paperwork

Correspondence with the other party or the Court

Completion of any documents or forms

If you have received Small Claims Court papers about a Claim against you, you are the Defendant. If you need a lawyer to prepare the Defence when you respond to the claim this fixed fee may assist. Your lawyer will require paying their fee whether you win or lose the case.

Advice on what can and should be included in your Defence

Drafting the Defence

What's not included:
